Terms of Use

These terms govern your use of dodaitech.com, operated by dodaitech LLC ("dodaitech", "we", "us"). By using the site you accept these terms. If you become a client, the services we provide are governed by a separate written estimate or agreement, which takes priority over these terms for that work.

1. The website is for information

This website describes our services so you can decide whether to contact us. Nothing on it is a binding offer. Service descriptions, examples, demo conversations and sample videos are illustrations. The exact scope, price and timeline for your project are only fixed in a written estimate or agreement that you and we have approved.

2. Estimates and consultations

Consultations are free and carry no obligation. Any estimate we send is valid for 30 days unless it says otherwise, is based on the information you gave us, and may change if the scope, site conditions or requirements change. Work begins only after you approve the estimate in writing (email or WhatsApp counts as writing).

3. No guarantee of results

Technology helps a business run better, but results depend on many things outside our control: your market, your team, your customers, your internet provider, and the platforms you use. We do not promise any specific increase in sales, bookings, reviews, followers, response times or other business outcomes.

4. Third-party platforms

Our services rely on platforms we do not control, such as WhatsApp and Meta, Google, internet providers, AI model providers, payment and booking tools, and hardware manufacturers. Those platforms can change their features, prices, policies or availability, or suspend accounts, at any time. We are not responsible for their actions or outages. Where possible, accounts are opened in your business name so that you own them.

5. Licensed and regulated work

Some work is regulated. In Texas, installing security camera and alarm systems requires a state license under the Private Security Act. Where a license is required, that work is performed by a licensed and insured installer, and we tell you who that is before the work begins. Electrical work beyond low-voltage cabling is referred to a licensed electrician.

6. Your responsibilities

If you work with us, you are responsible for:

  • Keeping backups of your data and knowing your own passwords and account credentials. We help you set these up, but you own them.
  • Giving us accurate information and timely approvals, and safe access to your premises and systems.
  • Using any messaging, chatbot or voice system lawfully: obtaining your customers' consent before sending marketing messages, honoring opt-outs, and disclosing when a customer is talking to an automated assistant or being recorded, as the law requires.
  • Complying with rules specific to your industry, such as health-privacy rules for clinics.
  • Reviewing and approving websites, videos and advertising content before they are published, including any claims they make about your business.

7. Intellectual property

The dodaitech name, logo, website design, text, images and demo content are ours or licensed to us. You may not copy, scrape, reproduce or reuse them without written permission, except to share a link to the site.

For client projects, unless the agreement says otherwise: you own the custom deliverables we create for you once they are paid in full; we keep ownership of our pre-existing tools, templates, code libraries, prompts and know-how, and you receive a license to use them as part of your deliverable; and open-source or third-party components remain under their own licenses.

Videos and images generated with AI tools are delivered under the licenses of those tools, which we identify on request. AI-generated content may not be protected by copyright, and we do not warrant that it is. You are responsible for obtaining permission to use any person's likeness, voice, brand or music that you ask us to include.

8. Website availability and accuracy

We try to keep this website accurate and available, but it is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose or non-infringement. We may change or remove content at any time.

9. Limitation of liability

To the fullest extent permitted by law, dodaitech, its members, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, business interruption or cost of substitute services, arising from your use of this website or reliance on its content, even if we were told they might occur.

Our total liability for any claim related to this website will not exceed one hundred US dollars ($100). Liability for services provided to clients is limited as set out in the written agreement for that work. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Acceptable use

You agree not to use this website or our contact channels to send spam, abusive or unlawful content, to attempt to access systems you are not authorized to access, to interfere with the site's operation, or to collect information about other users.

11. Links to other sites

This site links to third-party sites and services, including WhatsApp. We do not control them and are not responsible for their content or privacy practices. Your use of them is governed by their terms.

12. Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute about this website will be brought in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction. Before filing any claim, you agree to contact us and give us 30 days to try to resolve it.

13. Changes to these terms

We may update these terms at any time by posting a new version here with a new "last updated" date. Continued use of the site after a change means you accept the updated terms.

14. Language

These terms are published in English and Spanish. The Spanish version is provided for convenience. If there is a conflict, the English version controls.
